User hereby acknowledges that this paragraph shall apply to all content, merchandise and services available through tLa Muebleria NY Inc’s website. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Sales Terms

1. All orders are subject to availability from the manufacturer.

2. All orders require payment in full before delivery, unless otherwise agreed.

3. The information provided on this website is accurate to the best of our knowledge. However, occasionally, there could be typos or errors. We are not obligated to honor or be responsible for these errors. Types of errors are, and not limited to: pricing errors, colors, incorrect delivery charges, dimensions etc.

4. Measurements / dimensions are provided by manufacturers and in 99% cases are very accurate, but can be slightly different (or sometimes incorrect). This is considered absolutely normal due to the fact any furniture is a man-made, hand-made product. Any measurement related issues or concerns are not subject for return/exchange.

5. You are responsible for measuring and making sure that your purchase will fit through doorways, stairways, into elevators, etc. In case merchandise does not fit, you may request a refund, with a deduction of a restocking fee of 35% of the original purchase price. Shipping charges will also be deducted from your refund. In case of free delivery some actual delivery charges may be deducted from your refund.

6. You are required to notify us about any unusual delivery conditions: floors, walk-ups, basement, etc., Most of these services are subject to an additional fee and must be discussed individually. In case of any conflicts at the time of delivery, we reserve the right to return the merchandise to the warehouse, refunding your payment minus any shipping charges and restocking fees (35%). If you are unsure whether the product will fit into your home, please do not hesitate to contact us before placing your order. You will be required to provide us with detailed descriptions, measurements and pictures of entrances and hallways.

7. Delivery must be accepted at the agreed upon day and time window. If you are not available for your scheduled delivery, additional re-delivery fees may be applied to your order.

8. Either you or your representative, that is 18 years of age or older, must be present to receive the merchandise at the agreed upon day and time window. If no one is available to receive the delivery, a re-delivery fee may be applied to your order.

9. The Delivery Company has been contracted to perform the delivery service to one room of choice at the delivery address. If the delivery cannot be made to this room, the transporters will place your products in an alternate room at the same address. Please make sure there is adequate access and space to complete the delivery – prior to delivery ensure that there is adequate room to make the delivery considering hallways, staircases and elevators.

10. There may be circumstances that require additional payment by you if the conditions mentioned have not been met or you require special services outside of our standard delivery. [For example, if you need a specified time window, your address is not tractor trailer accessible, you were not available for your scheduled delivery, delivery not made due to unsafe conditions, not indicating missing pieces on the delivery note, etc.]

11. While some measures are taken to avoid damaging any property while delivering the furniture, which are generally heavy and bulky merchandise, we are not responsible for any accidental property damage that may occur. Including, but not limited to, Floors, Rugs, other furniture and appliances.

12. You are responsible for checking your order confirmation email for accuracy. In case of any mistakes in your order you are required to contact us as soon as possible for corrections. If re-delivery is required due to incorrect shipping address, additional re-delivery fees may be applied to your order.

13. Special orders are not cancellable, You will be contacted by the e-mail you have provided to confirm if the order you have placed contains any merchandise that has to be special ordered.

14. Prices are subject to change without notice. We undertake no responsibility to honor pricing or any other errors on our website.

15. We are not responsible for any packaging/boxes that have been left after completion of delivery.

16. We are not responsible for any delays in your delivery. We will notify you in advance if the scheduled delivery date has been changed.

Cancellation Policy

1. All Orders can be cancelled for a full refund within 24 hours of placing the order.

2. Any cancellations after 24 hours of placing the order is subject to a 35% cancellation fee.

Order Acceptance/Confirmation
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order nor does it constitute confirmation of our offer to sell. La Muebleria NY inc’s website reserves the right at any time after receipt of your order to accept or decline your order for any reason without notice.

Product Display/Colors
La Muebleria NY Inc’s  website attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the color you see matches the product color, as the display of the color depends, in part, upon the monitor you are using.

Returns
Merchandise received in good condition is not returnable or cancelable. No refunds are available.

Damages/ Defects
All damages must be reported within 24 hours of receiving merchandise.
